Waiver of Liability

By booking or participating in any activity at Tempo Golf, you acknowledge and agree to the following Liability Waiver and Assumption of Risk:

Acknowledgement of Risk

Golf swings, golf equipment, flying golf balls, and simulator environments carry inherent risks of injury. By entering Tempo Golf, you understand and voluntarily accept all risks associated with using the facility, including but not limited to:

• Struck-by‑club or struck‑by‑ball injuries

• Slips, trips, or falls

• Equipment malfunction or misuse

• Strains or injuries resulting from physical activity

Release of Liability

To the fullest extent permitted by Ontario law, you agree to release, waive, and hold harmless Tempo Golf, its owners, staff, contractors, and affiliates from any and all claims, demands, damages, or causes of action arising from:

• Personal injury

• Property damage

• Accidents resulting from your actions or the actions of your guests

• Misuse of the golf simulators, equipment, or facility

This release applies regardless of whether the incident arises from negligence (excluding gross negligence or intentional misconduct).

Responsibility for Guests

The person who books the bay is responsible for ensuring all guests:

• Understand and follow safety rules

• Behave in a manner that protects themselves, others, and equipment

You assume responsibility for the conduct and safety of everyone in your group.

Equipment Damage

You agree to pay the full repair or replacement cost for any damage caused by you or your guests to:

• Simulator screens

• Projectors and sensors

• Furniture and fixtures

• Clubs or rental equipment

Accidental contact, reckless swings, or improper use remain your responsibility.

Health & Fitness

You confirm that you are physically able to participate in golf activities and will stop play if you feel unwell or unsafe. Tempo Golf is not responsible for injuries resulting from pre-existing health conditions.

Surveillance Cameras

You acknowledge that Tempo Golf uses security cameras for:

• Safety monitoring

• Theft and damage prevention

• Incident investigation

Cameras do not record audio and do not monitor private areas such as washrooms.

Compliance with Rules

You agree to follow all posted rules, safety guidelines, and staff instructions. Failure to comply may result in removal from the facility without refund.

Agreement Upon Booking

By booking a bay, entering the facility, or participating in any Tempo Golf activity, you confirm that you:

• Have read this waiver

• Understand it

• Agree to be bound by it on behalf of yourself and any minors or guests under your supervision

This waiver applies to every visit unless revised by Tempo Golf.
